Labor practices

We remain committed to the Collective Negotiation Agreements.

In 2022, there were a total of 83 incidents of labor abnormalities with loss of man-hours distributed as follows: 10 of them correspond to the Central regional, 32 to the Orinoco regional, 11 to the Caribbean regional and 29 to the Andean East regional. Additionally, 1 transversal incident was recorded at the national level.

The main issues that generated the incidents of labor abnormalities are related to: Right Association and Freedom of union in the framework of the elections of the negotiations of the next collective agreement with ECP and new board of directors at the national level; salary aspects, benefits, and indemnities of contractor people, such as Alleged labor breaches for this population.

We manage mobility

Ecopetrol S.A. has mechanisms that make easer assignment of his employees in companies of Ecopetrol Group and external entities, such as transfer to different regions of country within company, all under equity principles and competitive conditions assurance.  

Internal Mobility

The internal mobility of Ecopetrol S.A. can be definitive in a new work location or temporary, ensuring with the latter the return of the employee to his original work location.

During 2022 a total of 379 transfer actions were carried out, 291 transfers (77%) of definitive changes of work location and 88 actions (23%) of temporary transfers. The total number of workers transferred was 353; a worker may have more than one transfer during the year. The characterization of this population is as follows: Men: 270 (76%), Women: 83 (24%).


 

 

External mobility

Ecopetrol S.A.'s external mobility applies when due to organizational needs it is required to cover a position/leadership role, tactic and operational in a Company of the Ecopetrol S.A. Group or derived from a collaboration agreement signed with state entities. This process may occur with or without suspension of the labor contract. To the level of State entities always is without suspension of contract. 

As of December 31, 2022, there are a total of 245 current processes of assignments in external mobility: a total of 239 actions (98%) with suspended contracts and 6 actions (2%) with active contracts. 99% of the processes correspond to assignments in Ecopetrol Group companies and 1% to different external entities. The gender characterization is as follows: Men: 221 (90%) and Women: 24 (10%).






 








 

Retirement plan

During 2022, Ecopetrol S.A. continued applying retirement plan approved by Company's board directors as a Human Talent planning strategy, with respect to workers who had more than 20 years of career and met the other established requirements. 65 people accepted retirement plan in the term of 2022 and the consolidated total of workers disassociate under this modality between 2020 and 2022 was 580 people.

Pension obligations - pension process at Ecopetrol

By express mandate of Article 279 of Law 100 of 1993, the employees of Ecopetrol S.A. were exempted from the application of the Integral Social Security System contemplated therein.

 Subsequently, Law 797 of 2003 included as mandatory members of the General Pension System the employees that joined Ecopetrol as of the effective date of the law, that is, January 29, 2003; however, the exception contained in the mentioned Article 279 of Law 100 of 1993 was maintained with respect to pensions for the employees that had been hired prior to that date.

 On July 31, 2010, by virtue of the provisions of Legislative Act 01 of 2005, the exempted pension regime expired and therefore as of August 1, 2010, all employees of the company that as of July 31, 2010 did not acquire a pension right under Ecopetrol are linked to the General Pension System. The employees who retired by retirement in charge of Ecopetrol for having consolidated their right on July 31, 2010 continue to receive allowances and social benefits (health services of the employee and their registered family members), as well as educational benefit in charge of the Company.

 Regarding workers affiliated to the General Pension System, Ecopetrol makes the periodic contributions that by law correspond, being the respective pension administrators who assume the obligations in pension matters. The health and education benefits to which they are entitled are part of Ecopetrol's labor liabilities.
